1. Acceptance of Terms

By accessing or using any services provided by Instahub Inc (“Instahub,” “we,” “our,” or “us”), including but not limited to our website, CRM platform, hosting, and marketing services (collectively, the “Services”), you (“Client,” “you,” or “your”) agree to be bound by these Terms and Conditions (“Terms”).

If you do not agree with these Terms, you must not use our Services.

2. Scope of Services

Instahub Inc is an all-round digital marketing company providing a wide range of services, including but not limited to website design, hosting, CRM management, automation setup, lead generation, social media marketing, search engine optimization (SEO), and paid advertising campaigns.

We may also provide additional or customized marketing services to meet individual client needs. The list of services provided is not exhaustive or exclusive, and Instahub reserves the right to expand or modify service offerings as required.

3. Payments and Billing

Instahub Inc offers two payment options:

Online Payments: via secure checkout on our website.

Invoicing: processed through Stripe. Stripe securely stores client billing information; Instahub Inc does not have access to your credit card details.

By submitting payment, you authorize Instahub Inc to charge future invoices automatically for ongoing services, subscriptions, or renewals as applicable.

All invoices are due upon receipt unless otherwise stated. Late or failed payments may result in suspension or termination of service.

4. Competitive Pricing and Service Structure

Instahub Inc provides below-market pricing for our services due to our integrated structure, which includes ongoing monthly fees for CRM access, hosting, and related systems.

All content, funnels, automations, and systems created within the Instahub CRM remain hosted within our platform.

Clients may transfer their account for free directly to GoHighLevel (GHL) using our affiliate link.

If a client chooses not to use our affiliate link, Instahub reserves the right to charge a transfer-out fee of up to $1,000 CAD or decline the transfer request at our discretion.

5. Cancellation Policy

CRM and hosting subscriptions require 30 days’ written notice prior to cancellation.
Cancellations must be submitted in writing to [email protected].

Failure to provide 30 days’ notice will result in billing for the following month.

6. Data Ownership and Access

All data collected by the client through their Instahub CRM — including leads, contacts, and communications — belongs solely to the client. Clients may export their contact data at any time upon request.

Instahub Inc may retain anonymized usage data for performance and analytics purposes only.

7. Prohibited Use and Compliance

Clients agree not to use Instahub’s systems or services for spam, unsolicited communication, or unlawful activities.

All email, SMS, and digital communications must comply with:

Canada’s Anti-Spam Legislation (CASL)

Telephone Consumer Protection Act (TCPA), if applicable

General Data Protection Regulation (GDPR), if applicable

Other relevant laws in the client’s jurisdiction

Instahub reserves the right to suspend or terminate any account that violates these requirements.

8. Suspension and Termination

Instahub Inc reserves the right to suspend or terminate any account or service at any time, with or without notice, if:

Payment is overdue,

The account engages in spam or fraudulent activity,

There is a breach of these Terms or any applicable law, or

Service misuse affects platform performance or security.

Upon termination, the client remains responsible for any outstanding balances.

9. Intellectual Property

All materials, templates, branding, and proprietary tools developed by Instahub Inc remain the intellectual property of Instahub Inc unless explicitly transferred under a written agreement.

Clients are granted a non-exclusive license to use deliverables (websites, designs, campaigns) for their own business purposes.

10. Limitation of Liability

To the fullest extent permitted by law, Instahub Inc shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to loss of revenue, data, or profits resulting from use or inability to use our services.

Total liability for any claim shall not exceed the total amount paid by the client for the service in question.

11. Refunds

Due to the digital and service-based nature of our work, all payments are final unless otherwise stated in a specific written service agreement.

Setup fees, onboarding costs, and subscription payments are non-refundable once work has commenced.

12. Optional Add-Ons and Premium Features

Instahub Inc offers a range of optional add-on features to enhance your marketing system, including but not limited to SMS messaging, WhatsApp integration, WordPress hosting, phone calling, AI tools, and other premium upgrades.

These add-ons are not included in standard packages and may incur additional costs based on usage or third-party fees.
By enabling or using any of these features, you acknowledge and agree that:

Additional Charges: Fees may apply per message, call, contact, or transaction as outlined in your plan or invoice.

Responsible Use: You are solely responsible for ensuring that these features are used lawfully and ethically, including compliance with applicable anti-spam and privacy regulations such as CASL, TCPA, and GDPR, as well as carrier and platform policies.

Third-Party Services: Certain add-ons may rely on third-party vendors or APIs (e.g., Twilio, OpenAI, WhatsApp, WordPress). Instahub Inc is not liable for any downtime, rate changes, or limitations imposed by these providers.

Account Suspension: Misuse of any communication or automation feature (SMS, email, AI, or otherwise) may result in immediate suspension or termination of your account without refund.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.

Any disputes shall be resolved exclusively in the courts of Toronto, Ontario.
